The agreement does not change the definition or types of sanctionable practices. These are common to all MDMs (with the exception of the obstruction practices contained in the banking group`s definitions, but which are not part of the sanctionable practices covered by the supervisory agreement). This document sets out the terms of the agreement between the African Development Bank Group, the Asian Development Bank, the European Bank for Reconstruction and Development, the Inter-American Development Bank Group and the World Bank Group on Mutual Recognition and Implementation of the participating institution`s longshore mechanisms and decisions. Under a new agreement, companies that have been excluded from a multilateral development bank (MDB) may be punished for the same misconduct committed by other signatory MDBs. Indonesian company PT. Suburo Jayana Indah Corp. (“Sujainco”) was also suspended for two years due to fraud and collusion in Indonesia`s World Bank-funded water resource management and irrigation program. [iii] In accordance with Sujainco`s transaction agreement, it agreed with a third party and other bidders to submit artificial and non-competitive bids prior to the bid. Sujainco also admitted to filing false documents to recover payments while the contract was being executed. The Sujainco lock is also more than a year old, This means that Sujainco will face cross-closure by other MdBs. [ii] On 9 April 2010, the Asian Development Bank Group, the African Development Bank, the European Bank for Reconstruction and Development, the Inter-American Development Bank Group and the World Bank Group signed the agreement on mutual implementation of longshore decisions.

An unlocking decision is permitted for cross-sectional information when it applies (1) for fraud, corruption, collusion or coercion (we note that obstruction is a practice of sanctioning all signatories, but is not eligible for confinement); (2) is public; (3) unlocking exceeds one year; and (4) is not based on a decision of a national authority or other international authority.
